End User License Agreement (EULA) for Breaking Point

This End User License Agreement ("Agreement" or "EULA") is a legal agreement between you ("User" or "You") and Breaking Point Media Inc. ("Company", "We", "Us", or "Our") governing your use of the Breaking Point platform, including its website, mobile applications, and other related services (collectively, the "Service").
By creating an account or using the Service, you acknowledge and agree to the terms of this EULA, our Code of Conduct, Terms of Service, and Privacy Policy. If you do not agree to these terms, do not use the Service.
1. Grant of License
Breaking Point grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for personal, non-commercial purposes, subject to this Agreement and our policies.
2. User Responsibilities
- Comply with the Code of Conduct and Terms of Service.
- Use the Service for lawful purposes only.
- Not modify, distribute, sell, or reverse engineer any part of the Service.
- Not engage in disruptive, harmful, or abusive behavior.
- Not upload, post, or share objectionable content as outlined in our Code of Conduct.
3. User-Generated Content
The Service allows users to share content ("User Content"). By posting or submitting User Content, you grant Breaking Point a non-exclusive, royalty-free, worldwide license to use, display, and distribute such content in connection with the Service.
4. Content Moderation & Reporting
- A content filtering system to prevent objectionable material.
- User reporting tools to flag inappropriate content.
- Blocking and enforcement measures against abusive users.
5. Termination
Breaking Point reserves the right to suspend or terminate your access to the Service at any time without notice if:
- You violate this Agreement or our policies.
- We detect illegal, harmful, or abusive behavior.
- We choose to discontinue the Service.
6. Privacy & Data Protection
Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your personal data in accordance with applicable data protection laws (e.g., GDPR).
7. Intellectual Property Rights
Unless otherwise stated, Breaking Point owns all intellectual property related to the Service. No rights are transferred to users except for the limited license granted under this Agreement.
8. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind, express or implied. Breaking Point makes no guarantees regarding availability, accuracy, or security.
9. Limitation of Liability
Breaking Point shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service, to the fullest extent permitted by law.
10. Governing Law & Disputes
This Agreement is governed by the laws of Delaware, United States. Any disputes shall be resolved in the courts of Delaware.
11. Changes to this Agreement
Breaking Point may update this EULA at any time. Continued use of the Service after changes take effect constitutes acceptance of the revised Agreement.
